MOTHER’S DAY OCEAN MINI SESSIONS

WITH SEA THROUGH THE LENS PHOTOGRAPHY

TERMS AND CONDITIONS

The following terms and conditions represent the terms and conditions upon which you agree to participate in this photography session.

1. ENTIRE AGREEMENT: This agreement contains the entire understanding between Sea Through The Lens Photography and the Client. It supersedes all prior and/or any other verbal or other agreements between the parties. Additions or alterations to this agreement will only be recognised if in writing and signed by both parties.

2. BOOKINGS: Upon receiving written confirmation and the required deposit, Sea Through The Lens Photography will reserve the time/s and date/s agreed upon, and will not make any other reservations for that period. For this reason, the booking deposit is non refundable for any reason what so ever. The booking deposit is to be paid at time of signing the contract. The booking deposit is applied towards the agreed and contracted photography package. The Client understands and agrees that the total amount owed for the photography package described in the contract is due no later than 7 days prior to the scheduled session.

3. CANCELLATION: In the event that the Client cancels the contracted services for photography outlined in this contract before the scheduled session takes place, the deposit will be forfeit. In the event Sea Through The Lens Photography is unable to fulfil their photographic obligations due to no fault of the Client, all monies paid by the Client will be refunded.

4. COPYRIGHTS: The photographs produced by Sea Through The Lens Photography are protected by Australian Copyright Law (all rights reserved) and may not be reproduced in any manner without Sea Through The Lens Photography’s express written permission. The Client has limited copyright ownership of the resulting images which will be transferred to the Client under the following conditions:

  • The digital Images and digital files are the property of the Client for personal use and for the purposes of the reproduction and distribution of photographs to friends and relatives.

  • The Client must obtain written permission from and compensate Sea Through The Lens Photography prior to an event where the Client, the Clients friends or relatives publish or sell the photographs for profit.

  • The Client must not edit or apply filters to final images provided by Sea Through The Lens Photography.

  • When posting images taken by Sea Through The Lens, please provide credit by tagging @seathroughthelensphotography.

5. MODEL RELEASE: The Client hereby assigns and grants Sea Through The Lens Photography and its legal representatives the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright same. The Client hereby releases Sea Through The Lens Photography and its legal representatives and assigns from all claims and liability relating to said photographs. It is agreed that Sea Through The Lens Photography may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in malls, photography books, photography instructional books, store fronts, window displays, studio display, television, advertising, magazine advertising and any other purpose thought proper by Sea Through The Lens Photography.

6. COMPLETION SCHEDULE: Digital processing can take approximately 6 weeks from the conclusion of your session.

7. FINAL DELIVERY: Sea Through The Lens Photography will provide the Client with a password protected, private downloadable online gallery of high resolution edited photographs. You acknowledge that you are familiar with our style and that our work is continually evolving and of a unique and artistic nature, that the photos taken may be different to those in the past and that Sea Through The Lens Photography will use our expertise and creative judgement to create images consistent with our vision of your session. Sea Through The Lens Photography does not provide RAW images.

8. PAYMENTS: The Client agrees that the deposit is required at the time of contract acceptance and 100% of the remaining balance is due 7 days prior to the scheduled session.

9. METHOD OF PAYMENT: Payment can be made via credit card or direct deposit as per your invoice.

10. RIGHT OF WITHDRAWAL: Sea Through The Lens Photography’s discovery of new information, changes to agreed circumstances, or other factors which tend to circumvent its policies may result in its withdrawal. Non-cooperation; changes in locations, facilities or available times; missed appointments and late payments are examples of such factors. In the event Sea Through The Lens Photography withdraws, all payments made to date will be returned, excluding the deposit as well as fair market value for all services/products already provided.

11. LIMIT OF LIABILITY: In the unlikely event of severe medical, natural, or other emergency, it may be necessary to reschedule your session. Sea Through The Lens Photography will make every effort to reschedule your session to a date that suits both parties as soon as possible. If such a situation should occur and a suitable solution cannot be found, responsibility and liability is limited to the return of all payments received for the photographic package.

Sea Through The Lens Photography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of the Clients images being lost, stolen or destroyed for reasons within or beyond Sea Through The Lens Photography’s control, the latter’s liability is limited to the return of all payments received for the photographic package. The limit of liability shall not exceed the contract price stated herein.

The Client acknowledges that the ocean is an everchanging and unpredictable environment and therefore water clarity and/or marine life encounters can never be guaranteed. Sea Through The Lens Photography will do their utmost to provide the Client with the best conditions and opportunities possible, however a degree of flexibility from the Client may be required. If the Client is unable to be flexible, Sea Through The Lens Photography will work with the conditions on the day to provide images in and around the ocean to the best of their ability, however dissatisfaction of the clarity of the water or lack of marine life is not a valid reason for termination of this Agreement.

The Client agrees to show the utmost respect to any/or all marine life encountered and will follow all instructions provided by Sea Through The Lens Photography. Should any disrespect to marine life be shown, Sea Through The Lens Photography reserves the right to end the session immediately.

Sea Through The Lens Photography will take all necessary precautions to ensure the safety of the client to the best of our ability, however; the client recognises that the ocean is unpredictable and that Sea Through The Lens Photography cannot be held liable for any incidents that may occur. The client acknowledges that the beach and/or ocean is not owned, operated, supervised, managed or controlled by Sea Through The Lens Photography, the client will enter the ocean at their own risk and confirms they are confident in the water.

The client agrees to indemnify, defend, hold harmless and release Sea Through The Lens Photography from all liability to the client or their family for any loss or damage resulting from physical or mental injury, death or property damage arising from their/their families participation in any ocean activity.

12. COOPERATION: The client agrees to full cooperation with Sea Through The Lens Photography during the entire session time and acknowledges that Sea Through The Lens Photography cannot be held liable for any results of poor cooperation on the Clients behalf. The client understands and agrees that the ocean can be heavily impacted by the weather, therefore a degree of flexibility is required for underwater photoshoots. Should the photographer deem the ocean conditions unsafe the photographer reserves the right to reschedule the session to another day or change location to a safer option.

13. PERFORMANCE: The performance of this contract is contingent upon acts of God, weather, flood, fire, warfare, pandemic, government laws or regulations, electrical failure, equipment failure, strikes by suppliers, and/or any conditions beyond its control.

14. SEVERABILITY: If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and all other provisions of the agreement shall remain in full force and effect.

15. AMENDMENTS: This contract has been freely negotiated and shall be recognised as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by the Client and Sea Through The Lens Photography at the time of acceptance of this contract shall be recognised as amendments to this contract.

I have read and understood the terms above. By paying the deposit I hereby agree to the terms of this agreement.
